We reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time and for any reason. We will alert you about any changes by updating the “Effective date” of these Terms, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Terms to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted the changes in any revised Terms by your continued use of the Website after the date such revised Terms are posted.

In the event of any inconsistency or conflict between these Terms and the terms of any agreement, service order or statement of work, the terms of the agreement, service order or statement of work shall control.

The original language of these Terms is English. We may make available translations of these Terms in other languages for convenience. In case of conflicts between the original English version and any translation, the English version shall prevail.

Description of Services

The Services are aimed to provide you with assistant services with the scope of questions that may include booking restaurant reservations, obtaining tickets to a show or concert, planning and booking travel, ordering and delivering special gifts, finding local service providers, etc. The Services are provided to you according to these Terms and Privacy Policy.

Territorial Scope

The Services are intended for customers located worldwide, provided that the customers have banking products that include our Services from banks registered in and located within the territories of Kazakhstan.

We reserve the right to update or modify the territorial scope of the Services. Any such changes will be communicated to you through the Website or other appropriate means by our choice.

Access to the Services

You may gain access to the Services by undergoing the verification procedure to ensure that you have the right to access to the Services.

Using the Services

In order to use the Services you shall initiate a request by contacting us via phone, sending a message via communication tools, or email, that are specified on our Website, providing a concise description of your requirements. We reserve the right to refuse the fulfillment of request due to the objective impossibility of doing this or if your request violates the law and/or and moral standards. In this case we notify you about it and you have the right to withdraw your request or use the alternative solutions provided by us.

Upon receipt of your request, we confirm with you information that is required to fulfill your request. Communication regarding your requests can take place through a convenient channel of your choosing, be it messenger, email, or a direct call, with the execution timeline of the request mutually agreed upon during this interaction.

Additional Users

You are granted the right to utilize the Services for personal use and to extend it to up to three additional users of your choosing, at no additional cost. For any adjustments, regardless of the increase or decrease in the number of users, you need to initiate contact with us using your registered phone number and provide the necessary details of the designated individuals.

Fees and Payments

You acknowledge and agree that the Services are provided to you at no additional cost. However, any services, goods, or works necessary to fulfill your request shall be solely paid by you at the prices specified by the third parties providing these services, works, and goods.

We are not responsible in any case if your request is not fulfilled due to the lack of the required payments that you were aware of and that are necessary for fulfilling your request.

Intellectual Property

All intellectual property rights subsisting in respect of the Services belong to us or have been lawfully licensed by us for use in connection with the Services. All rights under applicable laws are hereby reserved. You are not allowed to upload, post, publish, reproduce, transmit or distribute in any way any component of the Website itself or create derivative works with respect thereto, as the Website is copyrighted under applicable laws.

You agree that we are free to use, disclose, adopt and modify all and any ideas, concepts, knowhow, proposals, suggestions, comments and other communications and information provided by you to us (the "Feedback") in connection with the Services and/or your use of the Services without any payment to you. You hereby waive and agree to waive all and any rights and claims for any consideration, fees, royalties, charges and/or other payments in relation to our use, disclosure, adoption and/or modification of any or all your Feedback.

Except as may be the result of standard search engine or Internet browser usage, use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the Services and Website, or using or launching any unauthorized script or other software.
Make any unauthorized use of the Services and Website by electronic or other means for the purpose of sending unsolicited email, by automated means or under false pretenses.
Use the Services and Website as part of any effort to compete with us or otherwise use the Services, Website and/or the Content for any revenue-generating endeavor or commercial enterprise.

Limitation of Liability

IN NO EVENT SHALL OUR AGGREGATE LIABILITY AND OUR AFFILIATES ARISING OUT OF OR RELATED TO THESE TERMS EXCEED EUR 100 (ONE HUNDRED). THE FOREGOING LIMITATION WILL APPLY WHETHER AN ACTION IS IN CONTRACT OR TORT AND REGARDLESS OF THE THEORY OF LIABILITY.

We may cease providing you with all or part of the Services at any time for any reason, including, but not limited to, if we reasonably believe that: (i) you have violated these Terms; (ii) you have deactivated Services as part of a product that includes them; or (iii) your bank, which includes the Services in its product, suspends or terminates the provision of Services to you. We will make reasonable efforts to notify you.

In all such cases, any provision of these Terms that expressly or by implication is intended to come into or continue in force on or after termination of these Terms shall remain in full force and effect.

Governing Law and Venue

These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of Kazakhstan.

Any legal action or proceedings arising out of or relating to these Terms shall be exclusively brought in the courts of Kazakhstan. The parties hereby consent to the jurisdiction and venue of such courts and waive any objections to the exercise of personal jurisdiction over them by such courts.

For the purposes of these Terms, the following rule of jurisdiction determination shall apply:

Customers served by Kazakhstan banks: These Terms shall be governed by and enforced in accordance with the laws of Kazakhstan, without regard to its conflict of laws rules.

By using our Services, the customer agrees to submit to the jurisdiction and venue as specified herein and acknowledges that any failure to comply with this provision may result in legal consequences.
